CMS-0057-F: prior-authorization denials your members can follow

From 2026, impacted payers must give a specific reason when they deny a prior authorization request, and decide faster. Here is what changed and what it means for the denial notice a member reads.

In 30 seconds

  • From January 1, 2026, a Medicare Advantage response to the provider must give a specific reason for a prior-authorization denial.
  • Standard decisions now come within 7 calendar days for Medicare Advantage and Medicaid managed care. Expedited Medicaid decisions come within 72 hours.
  • The member’s notice already had to state the reasons. It should now give the same reason, in words the member can act on.

What changed

The CMS Interoperability and Prior Authorization final rule (CMS-0057-F) applies to Medicare Advantage organizations, Medicaid and CHIP fee-for-service programs and managed care plans, and QHP issuers on the federal exchanges. Its prior-authorization process provisions began in 2026; its prior-authorization API follows in 2027. Check the rule for how each payer type is covered.

  • Medicare Advantage: beginning January 1, 2026, the response to the provider must include a specific reason for a denial, however it is sent (42 CFR 422.122(a))
  • Medicare Advantage: standard decisions on items and services subject to prior authorization within 7 calendar days, from January 1, 2026 (42 CFR 422.568(b))
  • Medicaid managed care: standard authorization decisions within state time frames of no more than 7 calendar days, for rating periods starting on or after January 1, 2026; expedited decisions within 72 hours (42 CFR 438.210(d))
  • Medicare Advantage: a prior authorization API beginning January 1, 2027 (42 CFR 422.122(b))

The member’s notice

The member’s own notice already had to explain the decision. A Medicare Advantage denial notice must use approved notice language in a readable and understandable form and state the specific reasons for the denial (42 CFR 422.568(e)). A Medicaid managed care notice must explain the reasons for the decision and meet the plain-language rules in 42 CFR 438.10 (42 CFR 438.404). With a specific reason now going to the provider, the member notice should give the same reason in words the member can act on.

Illustrative example

Response to the provider

Denied: criteria not met. No record of 6 weeks of physical therapy before the request.

The member’s notice

We said no for now because we need records showing you had 6 weeks of physical therapy first. Ask your doctor to send them by [date].

Same reason, two readers. The provider gets the specific reason; the member’s notice gives that same reason in words the member can act on. The wording here is a synthetic example, not approved notice language.

What to check in each denial notice

A short review list for a prior-authorization denial.

  • The reason is specific and matches the reason given to the provider
  • It says what the member can do next, by when, and how
  • Appeal rights and the expedited route are explained in plain words
  • Required notice language is kept word for word where it is approved language
  • Taglines and the notice of availability are attached where they apply

Questions

Does CMS-0057-F change the member’s denial notice?

Its specific-reason requirement is for the response to the provider. The member notice already has to state the reasons; the two should now agree.

Does it apply to drug prior authorizations?

The Medicare Advantage provisions exclude drugs. Check the rule for each payer type.

Is this legal advice?

No. It is a review aid. Confirm how the rule applies to your plan with your counsel.
